The incumbent in this critical position reports to the agency Deputy Director on regulatory, public records, records management, information governance, risk management, and governmental efficiency projects and related issues.  In this role, the individual directly manages the agency public records function, and provides legal and policy analysis related to agency emerging issues in collaboration with, and serving as a backup to, the Director of Legal and Regulatory Affairs.  The individual serves as a member of the program managers team, as the agency risk manager and privacy officer.

Policy, Legal, and Regulatory Projects

• Assist the Director of Regulatory Affairs with petitions for review under the Administrative Procedures Act and assisting with legal analysis in connection with regulatory affairs affecting the agency and individual divisions.
• Serve as the agency Director’s and Deputy Director’s primary assistant on assigned regulatory projects, economic development initiatives, and government efficiency projects.
• Draft and analyze proposed legislation related to financial industries, agency authority; or other issues related to the agency’s mission.
• Advise and provide analysis on administrative procedures act issues, small business economic impact statements and the regulatory fairness act.
• Proactively monitor state and federal legislative activity related to DFI’s mission or which may impact DFI’s functions.

Records Oversight & Information Governance

• Oversee all aspects of the records management program and the governance of agency records. 
• Consult and provide analysis on records protection, disclosure and compliance under both federal and state laws, including but not limited to the Gramm-Leach-Bliley Act and Bank Secrecy Act.
• Serve as a key leader in the collaborative development and implementation of records management best practices for agency records throughout the document lifecycle.    
• Lead and coordinate agency-wide records management and disclosure, including providing resources and training to agency employees in these areas. 
• Supervise DFI’s public records office and unit.
• Oversee e-discovery searches and implement litigation holds at the agency level, and serve as a point-of-contact for non-division-specific agency litigation.
• Coordinate all E-discovery and agency subpoena responses.
• Ensure that agency document retention policies are followed.
• Track and monitor public records disclosure metrics pursuant to RCW 40.14.026.

Ombudsperson

• Serve as the agency ombudsperson as directed by Agency or Division Directors when resolution cannot be reached between DFI divisions and DFI customers.  

Required Qualifications:
JD or equivalent law degree.

Desired Qualifications:

• Lean or other efficiency management training.
• Possess a broad knowledge of regulatory issues and state and federal laws affecting the financial services industry.
• Understand the internal and external political environment and be able to successfully navigate these environments to achieve the agency’s goals and objectives.
• Experience with Public Records Act and records management compliance, and a broad understanding of the legal framework around public records in Washington.
• Knowledge of regulatory processes and the Administrative Procedures Act (Ch. 34.05 RCW).  
• Excellent communication skills, including written and oral communication skills. Must be a skilled mediator and negotiator.
